Adoption of Code

GENERAL ORDINANCE NO. 912
    An ordinance adopting a new revision and codification of the ordinances of the Town of Westfield, New Jersey, providing for the repeal of certain ordinances not included therein, and for other purposes hereinafter set forth.

    WHEREAS, the Town Council of the Town of Westfield has caused its ordinances of a general and permanent nature to be compiled and revised and the same embodied in a compilation and revision thereof known as the "Code of the Town of Westfield, New Jersey," now therefore.

    BE IT ORDAINED by the Town Council of the Town of Westfield:

    SECTION 1. The ordinances of the Town of Westfield of a general and permanent nature, as codified in Chapters l to 31, both inclusive, are ordained as general ordinances and are hereby adopted as the "Code of the Town of Westfield, New Jersey."

    SECTION 2. All the provisions of the "Code of the Town of Westfield, New Jersey," shall be in force and effect on and after the 28th day of June, 1962 and all ordinances of a general and permanent nature, adopted by the Town Council prior to May 24, 1961, and not contained in the "Code of the Town of Westfield, New Jersey," are hereby repealed from and after the 28th day of June, 1962, except as hereinafter provided.

    SECTION 3. The repeal provided for in the preceding section of this ordinance shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the 28th day of June, 1962; nor shall such repeal affect any ordinance or resolution promising or guaranteeing the payment of money for the Town or authorizing the issue of any bonds of the Town or any evidence of the Town's indebtedness, or any contract or obligation assumed by the Town; nor shall such repeal affect the administrative ordinances or resolutions of the Town Council not in conflict or inconsistent with the provisions of the Town Code nor shall it affect any right or franchise conferred by any ordinance or resolution of the Town Council on any person or corporation: nor shall it affect the annual appropriation ordinance; nor shall it affect any ordinance fixing salaries or bonds of Town officers and employees; nor shall it affect the Building Code; nor shall it affect the health ordinances; nor shall it affect the zoning ordinances; nor shall it affect any ordinances providing for local or general public improvements; nor shall it affect General Ordinances Nos. 696 and 697, relating to the Rahway Valley Sewerage Authority; nor shall it affect General Ordinance No. 742, relating to provisions governing the use of water in refrigeration and air conditioning units; nor shall it affect any prosecution, suit or other proceeding pending or any judgment rendered on or prior to the 28th day of June, 1962; nor shall it affect any ordinance of the Town adopted on final passage since the 24th day of May, 1961.

    SECTION 4. Whenever in the Code adopted by this ordinance or any other ordinance of the Town any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in such Code or any other ordinance the doing of any act required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of such Code or any other ordinance shall be punished by a fine not exceeding two hundred dollars, or by imprisonment in the county jail for a period not exceeding ninety days, or by both such fine and imprisonment. Each day any violation of such Code or of any other ordinance shall continue shall constitute a separate offense. Whenever any such fine is imposed upon any corporation, such fine and costs and charges incident thereto may be collected in an action of debt or in such other manner as may be provided by law.

    SECTION 5. Each section of this ordinance and the Code hereby adopted is hereby declared to be a separate section, and the determination by any court of competent jurisdiction that any section or part thereof is void shall not affect the validity of any other section or part thereof.

    SECTION 6. A copy of the Code hereby adopted has been and is now filed in the office of the Town Clerk, and the Town Clerk shall keep at least one copy of such Code available for examination by the public.
