GENERAL ORDINANCE NO. AN ORDINANCE TO AMEND THE LAND USE ORDINANCE OF THE TOWN OF WESTFIELD TO AMEND THE LANGUAGE RELATING TO THE REGULATION OF SIGN HEIGHT

BE IT ORDAINED by the Town Council of the Town of Westfield in the County of Union as follows:

SECTION I.

Article 11, “Zoning”, shall be amended by revising Paragraph 3 in Subsection A of Section 16.03 to read as follows:

“3. The height of a sign shall be calculated as defined in Article 2, ‘height of building or structure’. For purposes of clarification, the term ‘height’ as used in this article refers to the distance between the highest elevation of any part of the sign structure or message and normal grade at the base of said sign, whereas the term ‘vertical dimension’ refers to the distance between the highest and lowest elevations of a portion of the sign, such as the sign background, sign panel, sign letters, numbers and symbols, all as indicated in the respective provision.”

SECTION II.

Article 11, Zoning, be amended by adding and inserting a new Paragraph 5 in Subsection B of Section 16.03, to read as follows:

“5. The height of any freestanding sign shall not exceed eight (8) feet, unless more restrictive standards in this article or elsewhere apply.”

SECTION III.

Article 11, Zoning, be amended by revising Paragraph 5 in Subsection B of Section 16.04 to read as follows:

“5. The height of any such freestanding sign shall not exceed five (5) feet.”

SECTION IV.

Article 11, Zoning, be amended by revising Paragraph 1 in Subsection C of Section 16.04 to read as follows:

“1. One (1) sign identifying the name of the multi-family dwelling development, and regulated as follows:

a. The sign may be freestanding or wall-mounted. If freestanding, the sign shall be located at least ten (10) feet from any property line and shall be placed parallel to the street. b. The area of the sign shall not exceed sixteen (16) square feet. c. The height of the freestanding or wall-mounted sign shall not exceed six (6) feet.

SECTION V.

Article 11, Zoning, be amended by revising Paragraph 1.b in Subsection E of section 16.04 to read as follows:

“b. The height of the sign shall not exceed the height of the ground floor, or twelve (12) feet, whichever is less.”

SECTION VI.

Article 11, Zoning, be amended by revising Paragraph 2.b in Subsection E of Section 16.04 to read as follows:

“b. The height of the sign shall not exceed the height of the ground floor, or

twelve (12) feet, whichever is less.”

SECTION VII.

Article 11, Zoning, be amended by revising Paragraph 3.a (3) in Subsection E of Section 16.04 to read as follows:

“(3) The height of any such sign shall not exceed the height of the ground floor, or twelve (12) feet, whichever is less.”

SECTION VIII.

Article 11, Zoning, be amended by revising Paragraph 3.b (3) in Subsection E of Section 16.04 to read as follows:

“The height of the sign shall not exceed the height of the ground floor, or twelve (12) feet, whichever is less.”

SECTION IX.

Article 11, Zoning, be amended by revising Paragraph 4.e in Subsection E of Section 16.04 to read as follows:

“e. The height of the sign shall not exceed eight (8) feet.”

SECTION X.

Article 11, Zoning, be amended by revising Paragraph 4.b in Subsection F of Section 16.04 to read as follows:

“b. The height of the sign shall not exceed the height of the ground floor, or twelve (12) feet, whichever is less.”

SECTION XI.

Article 11, Zoning, be amended by revising Paragraph 1.e in Subsection I of Section 16.04 to read as follows:

“e. The height of the sign shall not exceed six (6) feet.”

SECTION XII.

Article 11, Zoning, be amended by revising Paragraph 4 in Subsection J of Section 16.04 to read as follows:

SECTION XIII.

Article 11, Zoning, be amended by revising Paragraph 1.c in Subsection K of Section 16.04 to read as follows:

“c. The height of the sign shall not exceed six (6) feet.”

SECTION XIV.

All ordinances or parts of ordinances in conflict or inconsistent with any part of this ordinance are hereby repealed to the extent that they are in such conflict or inconsistent.

SECTION XV.

In the event that any section, part or provision of this ordinance shall be held to be unconstitutional or invalid by any court, such holding shall not affect the validity of this ordinance as a whole, or any part thereof, other than the part so held unconstitutional or invalid.

SECTION XVI.

This ordinance shall take effect after passage and publication as soon as and in the manner provided by law.
