The Board of Adjustment of the Town of Westfield, New Jersey will meet on Monday, August 14, 2000 in the Council Chambers at the Municipal Building, 425 East Broad Street, Westfield, New Jersey, at 7: 30 p. m. to hear and consider the following appeals for variance from the requirements of the Westfield Land Use Ordinance:

Eric Tichenor, 1343 Central Avenue seeking permission to erect an addition and deck contrary to the requirements of Section 11.09 E. 10 and 13.02 C. 3 of the Land Use Ordinance. Building coverage, not including deck proposed, of 26.6%, present is 25.9%. Ordinance allows 20%. Building coverage, including deck proposed is 30.1%. Ordinance allows 22%.

Taras and Kathleen Kozak, 327 Brightwood Avenue seeking permission to erect an above ground pool contrary to the requirements of Section 11.08 E. 10 of the Land Use Ordinance. Maximum building coverage proposed of 25.4%, includes above ground swimming pool at 5.0%. Ordinance allows 20%.

Richard Mattessich, 614 Lenox Avenue seeking permission to erect a deck contrary to the requirements of Section 13.02 C. 3 of the Land Use Ordinance. Maximum building coverage, including deck proposed is 25.9%, please note that the proposed deck is 1.7%. Present is 24.2%. Ordinance allows 22%.

Our House, Inc., 506 Boulevard seeking permission to increase the floor area ratio contrary to the requirements of Section 12.04 E and 11.12 E. 9 of the Land Use Ordinance with the intent of using these premises as a community residence for, and provide services to persons who are developmentally disabled, pursuant to P. L. 1977, C. 448, (C. 30: 11B1 et. seq.) which includes, but is not limited to: group homes, halfway houses, intermediate care facilities, supervised apartment living arrangements, and hospitals. The ground level space is designated and intended for year round occupancy, it is currently unheated. Heating this area increases the “habitable floor area”, therefore increases the floor area ratio. Floor area ratio proposed is 47%/ 3,150 square feet and presently at 42%. Ordinance allows 35%/ 3,200 square feet.

Ralph M. and Jill H. King, 225 Lynn Lane seeking permission to erect a deck and fence contrary to the requirements of Section 13.02 C. 2, 13.02 C. 1 and 12.07 C of the Land Use Ordinance. Minimum deck setback in side yard proposed of ± 14 feet. Ordinance requires 15 feet. Deck location proposed in side yard (this is a corner lot. The house faces contrary the zoning regulations yard conventions. Therefore, while the deck is technically by code in the side yard, it is functionally in the applicants rear yard). Ordinance allows only in rear yard. Maximum fence height in front yard proposed 6 feet. Ordinance allows 4 feet.

James Latulippe, 19 North Wickom Drive, seeking permission to erect a deck contrary to the requirements of Section 13.02 C. 1, of the Land Use Ordinance. Deck location proposed mostly in side yard. Ordinance allows only in rear yard.

Golden Bee Antiques, LLC (Tenant), 141 A East Broad Street seeking permission to display saleable goods outside of building contrary to the requirements of Section 11.25D. 1 of the Land Use Ordinance. Display of saleable goods, outside the confines of a building, even if on private property is not permitted.

Elena Ciervo, 427 South Avenue, West (Meeker’s Florest) seeking permission to erect/ use a free standing sign in a Central Business District contrary to the requirements of Section 16.04 E of the Land Use Ordinance. Proposed: to erect a free standing sign in lieu of a wall sign, in the Central Business District Zone. Ordinance does not permit freestanding signs.

Lady Bug Pest Service, 474 North Avenue, East seeking permission to erect/ retain sign on mobile storage unit in rear yard contrary to the Requirements of Section 16.04 E of the Land Use Ordinance. Ordinance does not permit this type of signage.

INVITATION TO BID

Invitations are extended to qualified Bidders to initially bid for the following Project:

ONE (1) WILDLAND FIREFIGHTING ENGINE FOR

THE FIRE DEPARTMENT

Bids will be accepted by mail or in person at the Scotch Plains Municipal Building, 430 Park Avenue, Scotch Plains, New Jersey 07076 (ATTN: Barbara Riepe, Township Clerk) until September 12, 2000 at 10: 00 a. m. At that time, the bids will be publicly opened and read aloud. All bids must be presented in sealed envelopes which are clearly marked “One (1) Wildland Firefighting Engine for the Fire Department, Township of Scotch Plains, 430 Park Avenue, Scotch Plains, New Jersey 07076”. No bid will be received after the time and date specified. After receipt of bids, no bid may be withdrawn within sixty (60) days after the date of the bid opening except if provided forth herein. The bid of any Bidder who consents to an extension may be held for consideration for a longer period of time as may be agreed upon between Bidder and the Township.

All bids must be on the bid forms provided by the Township of Scotch Plains in the Bid Package. Specifications and bid forms may be obtained for a nonrefundable fee of $25.00 at the Township Clerk’s Office, Municipal Building, Township of Scotch Plains, 430 Park Avenue, Scotch Plains, New Jersey, between the hours of 9: 00 a. m. and 4: 30 p. m. Monday through Friday.

Bid proposals and all required documents must be completed and submitted by the date set forth above. All documents in the enclosed Bid Package must accompany the bid proposal.

In addition to the above documents, a certified check, cashier’s check or bid bond issued by a responsible bank, trust company or insurance company, payable to the Township of Scotch Plains shall be submitted with each bid as a guaranty that if a contract is awarded the Bidder shall execute said Contract and furnish the bonds required by the Contract Documents (“ Bid Security”). The Bid Security shall be in the amount of ten percent (10%) of the total amount of the bid or TwnetyThousand Dollars ($ 20,000.00), whichever is lower.

All bid Security, except the Bid Security of the three (3) apparent lowest responsible Bidders shall, if requested in writing, be returned after ten (10) days from the opening of the bids (Sundays and holidays excepted) and the bids of such bidders shall be considered withdrawn.

The Township reserves the right to reject any or all bids, and to waive immaterial informalities, or to accept any bid which, in the opinion of the Township of Scotch Plains, will be in the best interest of the Township. The Township will evaluate all bids and any award will be made to the lowest responsible Bidder whose bid conforms to this solicitation.

The selected Bidder, will, within seven (7) days of award of the bid, enter into an appropriate contract with the Township.

All Bidders must comply with P. L. 1975, Chapter 127, entitled “An Act Relating to Affirmative Action in Relation to Discrimination in Connection with Certain Public Contracts and Supplementing the ‘Law Against Discrimination’ approved April 16, 1945 (P. L. 1945, Chapter 169)”, N. J. A. C. 17: 27, as amended from time to time, and the Americans With Disability Act.
